Liston LLP serves business leaders and their companies at the highest stakes — providing the strategic judgment and courtroom capability of a premier firm, delivered personally by a seasoned trial lawyer. One trusted advisor. No handoffs. No committees. Just direct, senior-level counsel when the stakes are highest.
Leaders in high-stakes situations face a familiar dilemma: hire a large firm and get a team where the relationship partner disappears after the pitch, or hire a smaller firm and worry about firepower. Liston LLP eliminates that trade-off.
The lawyer you hire is the lawyer who does the work. No leverage model, no associate staffing your brief while the partner plays golf. Every matter receives the full, personal attention of an experienced trial lawyer — from the initial strategy session through the final argument.
Litigation. Arbitration. Appeals. Transactional disputes. Strategic counsel. Liston LLP handles the entire range — from drafting an operating agreement and preparing a witness for arbitration to arguing a motion in federal court, all in the same week. One advisor who can see the full picture.
Choosing a boutique is not a concession — it's a signal. When opposing counsel sees a trial lawyer trained at the nation's top firms across the table, they know this isn't a cost-cutting move. It's a strategic choice by a sophisticated client. That changes settlement dynamics, and it changes courtroom outcomes.
Josh founded Liston LLP on a simple conviction: the leaders he serves — CEOs, founders, investors, and principals in complex businesses — deserve a lawyer they can call about anything, at any time, and receive direct, thoughtful counsel without filters or bureaucracy.
Josh built his practice over more than two decades at elite New York firms, including Davis Polk & Wardwell and Beys Liston & Mobargha LLP, handling high-stakes commercial disputes, securities matters, and complex arbitrations. After law school, he served as law clerk to the Honorable Dennis Jacobs of the U.S. Court of Appeals for the Second Circuit. He has tried and arbitrated cases across New York, and across the country, and has briefed and argued cases in multiple state and federal appellate courts.
A Harvard College alumnus — where he served as president of student government — Josh earned his law degree at Georgetown, where he was Editor-in-Chief of the law review. He combines rigorous analytical thinking with practical, results-oriented judgment. His clients rely on him not just for litigation, but as a strategic advisor on business disputes, governance questions, transactions, and the kind of problems that need a trusted lawyer's judgment before they become cases.
Every engagement draws on the same thing: a senior trial lawyer's judgment applied to your most consequential problems.
High-stakes business disputes in federal and state courts — partnership breakups, contract disputes, fraud claims, and fiduciary duty actions with significant dollars at stake.
First-chair representation in domestic and international arbitrations before the AAA, JAMS, and ICC, including post-acquisition disputes, joint venture breakdowns, and financial services controversies.
Briefing and oral argument in the New York Appellate Division, the Second Circuit, and other federal courts of appeals — both in matters originated by the firm and as appellate counsel brought in for the appeal.
Ongoing counsel to CEOs and principals on business disputes, governance issues, regulatory risks, and strategic decisions — the problems that need a trusted lawyer's perspective before they become litigation.
Direct representation in operating agreement, joint venture, and deal-related disputes, with coordinated specialist counsel brought in when the matter requires it.
Representation in government investigations, regulatory inquiries, and enforcement actions, including FINRA proceedings, subpoena responses, and internal investigations.

Most of our engagements begin with a referral from a trusted colleague or advisor. If we can be of assistance, we welcome hearing from you.
